Primero, por quedarte sin trabajo y, segundo, por desconocer si esa forma de comunicaci\u00f3n del despido es acorde a la ley. Es aqu\u00ed cuando el trabajador se pregunta <strong>\u00bfme pueden despedir por WhatsApp?<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">La respuesta, al menos hasta la fecha, es rotunda. <strong>No. No te pueden despedir a trav\u00e9s de WhatsApp<\/strong>. Para que la extinci\u00f3n de contrato sea conforme a la normativa laboral legal vigente, el despido debe comunicarse <\/span><span style=\"font-weight: 400;\">de forma clara y precisa, detall\u00e1ndose los hechos o las causas del mismo<\/span><span style=\"font-weight: 400;\">. Adem\u00e1s, esta comunicaci\u00f3n debe ser fehaciente, es decir, se debe conocer el emisor del mensaje, circunstancia que no es posible v\u00eda WhatsApp.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Todo ello, conforme a los art\u00edculos <\/span><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2015-11430\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">53 y 55 del Estatuto de los Trabajadores<\/span><\/a><span style=\"font-weight: 400;\">, donde se especifica c\u00f3mo debe ser la extinci\u00f3n de un contrato de trabajo tanto de forma objetiva como disciplinaria. El primero de ellos (art\u00edculo 53) <\/span><span style=\"font-weight: 400;\">detalla como requisitos para finalizar un contrato de forma objetiva la <\/span><i><span style=\"font-weight: 400;\">\u201ccomunicaci\u00f3n escrita al trabajador expresando la causa. Poner a disposici\u00f3n del trabajador, simult\u00e1neamente a la entrega de la comunicaci\u00f3n escrita, la indemnizaci\u00f3n de 20 d\u00edas por a\u00f1o de servicio [\u2026]\u201d.<\/span><\/i><\/p>\n<h2><span style=\"font-weight: 400;\"><strong>Despido WhatsApp: la empresa no puede comunicar un despido \u00fanicamente por esta v\u00eda<\/strong><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">En resumen y como ya se\u00f1al\u00e1bamos, <strong>la empresa no puede comunicarte tu despido \u00fanicamente por WhatsApp<\/strong>. Deber\u00e1 entregarte la carta en la que se detallen los motivos de la extinci\u00f3n del contrato, junto con la indemnizaci\u00f3n, si corresponde, y el finiquito. Todo ello por escrito de forma clara y de manera fehaciente.<\/span><\/p>\n<h6 style=\"text-align: center;\"><a href=\"https:\/\/www.reclamador.es\/blog\/tienes-firmar-la-carta-despido-finiquito\/\"><strong>\u00bfEs necesario firmar la carta de despido y el finiquito?<\/strong><\/a><\/h6>\n<h2><b>\u00bfQu\u00e9 debe hacer el trabajador ante un despido por WhatsApp?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Reclamar. El Estatuto de los Trabajadores marca el procedimiento legal para comunicar al trabajador su despido. De no ser as\u00ed, se puede reclamar el despido. \u00bfQu\u00e9 se consigue con esto? El proceso de reclamaci\u00f3n de un despido se lleva a cabo para que, en este caso concreto, se considere el <strong>despido como improcedente<\/strong>, lo que dar\u00eda lugar a una <strong>indemnizaci\u00f3n de 33 d\u00edas de salario por a\u00f1o trabajado<\/strong>, en lugar de los 20 d\u00edas que marca la ley para la extinci\u00f3n de contrato objetiva.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para reclamar, si te han despedido \u00fanicamente comunic\u00e1ndote esta situaci\u00f3n con un sms o un whatsApp, tienes 20 d\u00edas h\u00e1biles.
